1. General

Terms and Conditions govern the way in which Newey's Jewellers Ltd sells and markets its products to customers

Newey's Jewellers Ltd provide an excellent product and service and it is our wish that all customers read and understand the following guidelines.

Newey's Jewellers Ltd is a fully integrated ecommerce website providing a variety of precious jewellery products.

Orders are accepted only from the UK and Nothern Ireland.

Deliveries are only made to the UK and Northern Ireland.

By using this website (www.neweysjewellers.co.uk) you agree to be bound by these terms and conditions. Should you not agree to be bound by these terms you must not use this website for any purpose.

Your statutory rights are not affected by these terms and conditions, however, we reserve the right to refuse to supply goods or services at our discretion and without further explanation.

2. Offer and Acceptance

Once you “the Customer” have received confirmation of your order via either telephone, e-mail or by other means a legal binding contract has been created between you and Newey's Jewellers Ltd

Important notice – Any products that are bought, regardless of their point of purchase and origin, the contract is between you “the Customer" and Newey's Jewellers Ltd

3. Delivery

Orders will only be sent to the address where the debit or credit card is registered.

Newey's Jewellers Ltd deliver all orders in plain protective packaging. The return address noted on all recorded delivery will read:

All UK Mainland delivery orders are despatched using Royal Mail Special Delivery. You must be present at the delivery address to sign for your package.

UK Mainland Special Delivery deliveries not delivered will be held for 7 days at the specified local sorting office.

 All returned orders will carry a re-delivery charge.

Orders received at weekends and bank holidays are despatched next working day.

Orders placed on Friday will be despatched next working day.

Orders are processed immediately and dispatched within 1 – 30 working days depending on stock availability and production time.

 

Newey's Jewellers Ltd will contact the individual customer, using contact details provided, with any queries concerning their order via email in the first instance.

Any ordered delivery which is more than 30 working days overdue you are requested to contact neweysjewellers@hotmail.co.uk

All goods must be checked on delivery and you must notify us immediately by email if there is a problem or query with the item. 

Payment

Purchases can be made using credit and debit cards, and by BACS. All invoices are on a Pro-forma basis where by clear funds are required on all orders prior to despatch

All online purchases are presented to our merchant bank for verification and authorization. (note: All credit card transactions will appear as Newey's Jewellers Ltd on all credit card statements)

To assist in protecting customers from credit card fraud, a secure checkout for the encrypted delivery of sensitive customer information such as contact and credit/debit card details.

Newey's Jewellers Ltd do not store credit card details.

All personal details will not be passed onto any third party.

Pricing

All prices are clearly displayed relevant to their product catagories.

All prices are exclusive of, but subject to VAT at 20.0%

All prices are reviewed daily.

Following any discrepancy in our list price all customers will be notified of any error prior to despatch of goods. At this point all goods and services can be purchased and charged at the prevailing rate or the option to cancel the order.

Prices are shown in and transacted in pounds sterling.

Return/cancellation of orders as governed under UK law.

Newey's Jewellers Ltd  trade in accordance with recent EU directives for online and internet trading.

If, for any reason, you are not completely happy with your purchase simply return it to us within 14 days of placing your order and we will exchange it for an alternative  item or refund your money. The cost of returning item(s) to Newey's Jewellers Ltd will not be refunded.

IMPORTANT NOTICE –. Returned items are only accepted for exchange or refund if they have not been worn, damaged, resized, personalised or altered in any way. They must be in their original condition with the pink tag still attached in their original box and packaging. You must include all documentation which includes valuations and diamond certificates. Please email info@neweysjewellers.co.uk or phone us on 0121 233 1846 to notify us of your intention in advance of posting. Personalised means the addition of engraved messages, the addition of designs, patterns and textured finishes, and the adding further gem stones or diamonds to the original item. Earrings, bespoke handmade and cad cam orders are not covered in the 14 day money-back guarantee.

It is advised to keep proof of posting for all postal returns.

Data Protection

Newey's Jewellers Ltd holds your order details on a secure database for the purpose of fulfilling orders.

Your credit / debit card details are not held by Newey's Jewellers Ltd and cannot be accessed after an order has been placed.

Newey's Jewellers Ltd is compliant with the Data Protection Act. Therefore we will not pass your details on to any third party without your prior consent.

Newey's Jewellers Ltd operates an “opt in” policy in line with the Data Protection Act. We will only send promotional e-mails if you requested them. With each promotional e-mail we send, we will offer the opportunity to unsubscribe and therefore cease delivery of promotional-mails.

Limitation of Liability

Nothing in this Agreement shall affect the statutory rights of any customer or exclude or restrict any liability for death or personal injury arising from negligence or fraud of Newey's Jewellers Ltd.

Subject to the above clause, you agree that Newey's Jewellers Ltd shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any:

1.1 Loss of profits, revenue or goodwill or any type of consequential, indirect special loss or damage whatever arising from or in any way connected with this agreement

1.2 Direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the internet not under Newey's Jewellers Ltd direct control including, without limitation, damage for the loss of business, loss of sales, non payment of sims due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where Newey's Jewellers Ltd has been advised of the possibility of such loss or damage).

1.3 You also agree that (except in relation to such liability as has been expressly excluded in clause 1.1 above) the maximum aggregate of liability of Newey's Jewellers Ltd in contract, tort, negligence, statutory duty or otherwise (even where Newey's Jewellers Ltd been advised of the possibility of such loss or damage), for any loss or damage whatever arising from or in any way connected with:

1.3.1 Any defect in a product

1.3.2 Any failure by Newey's Jewellers Ltd to process signals, data, information, orders or messages correctly, or in a timely manner.

1.3.3 Any mis-routing or non-delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them.

1.3.4 Any liability not excluded by this agreement shall, in respect of any one or more events, or series of events (whether connected or unconnected) taking place within any twelve month period be limited, in the case of defects falling within clause 9.3a to three times the price of the relevant goods/services. This limit shall also apply in the event that any exclusion or other provision contained in this agreement is held to be invalid for any reason and Newey's Jewellers Ltd becomes liable for loss or damage that could otherwise have been limited.

1.4 You agree and acknowledge that you are in a better position than Newey's Jewellers Ltd to foresee and evaluate any potential damage or loss that you may suffer in connection with the goods and services provided by Newey's Jewellers Ltd and, therefore, that Newey's Jewellers Ltd cannot adequately insure in respect of such liability. You warrant to Newey's Jewellers Ltd that you will insure against, or bear yourself, any loss for which Newey's Jewellers Ltd has excluded liability.

1.5 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential. Accordingly some of the limitations of liability set out in this clause 1 may not apply to you.

Unlawful Provision

If any provision of these Terms and Conditions shall be unlawful, void or for any reason, unenforceable then that provision shall be excluded and shall not effect the validity and enforceability of the remaining Terms and Conditions.

Governing Law and Jurisdiction

This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Any disputes not resolved by normal complaints procedure shall be resolved exclusively in the courts of England and Wales under English law.
